Definitions: Pending Misdemeanor, Deferred Misdemeanor, and Misdemeanor Conviction

Definitions: Pending Misdemeanor, Deferred Misdemeanor, and Misdemeanor Conviction

There are 3 terms I use that you might not know exactly what I mean unless I define them - any of these can cause you to be rejected at certain apartments.



PENDING MISDEMEANOR

Also called a Misdemeanor Charge. Or Active Misdemeanor Charge.  This is an arrest where my client hasn't gone to court or accepted a Plea deal.  The criminal charge is open. Only a very few complexes will deal with this because if you are convicted, you might be jailed and thus wouldn't be able to pay your rent.

DEFERRED MISDEMEANOR

Also called a Deferred Adjudication for a Misdemeanor or a Adjudication Withheld for a Misdemeanor (depending on the State). This is a situation where you are offered Probation and after a period of time (usually 6 months, 12 months, or 24 months), if probation is finished Successfully and all fees are paid, the Misdemeanor is either DISMISSED or DISCHARGED.

MISDEMEANOR CONVICTION

When the Judge says your sentence, whether you receive 3 days in jail or straight Probation and Fined you have been typically been convicted. Some apartments will no longer consider applicants with certain convictions for a period of time (including forever).
