The Top 15 Most Difficult Misdemeanors To Place In Texas

The Top 15 Most Difficult Misdemeanors to place in Texas (but those we have placed are):

Below are a summary of all the misdemeanors we normally work with. I did want to outline the Top 10 Most Difficult because these Top 15, although they are "solvable" usually result in fewer options for our clients; this list is not in order of difficulty:



  1. DWI (second offense)
  2. Assault Family Violence (considered by most apts to be a violent charge)
  3. Assault with bodily injury (considered by most apts to be a violent charge)
  4. Burglary of a vehicle or vending machine
  5. Possession of marijuana (multiple convictions)
  6. Unlawful Carrying of a Weapon
  7. Violation of protective orders (considered by many to be a violent charge)
  8. Cruelty to animals
  9. Public lewdness (considered by most, but not all apts, to be a sexual crime)
  10. Unlawful restraint (considered by many apts to be a violent charge)
  11. Prostitution (considered by some, but not all apts to be a sexual crime)
  12. Terroristic threat (considered by many apts to be a violent charge)
  13. Theft of Property
  14. Minor Drug Possession or Possession of a Dangerous Drug
  15. Indecent exposure (considered by most, but not all apts, to be a sexual crime)

Class C Misdemeanors


Class C misdemeanors are considered the least serious type of Texas criminal offense. A traffic offense is a common Class C misdemeanor. Apartments can and sometimes will, decline for these offenses. Some other Class C offenses include

Disorderly conduct
Public intoxication
Bad checks
Simple assault (considered by many apts to be a violent charge)
Criminal trespass
Gambling
Bail jumping
Leaving a child in a vehicle
Petty theft such as shoplifting
Possession of alcoholic beverage in a motor vehicle

Class B Misdemeanors

Almost all apartments will review and will decline Class B misdemeanors unless they are older than that specific property cares about. They are considered more serious than Class C misdemeanors and the many (but not all apts) are concerned when someone has a Misdemeanor B. Examples are

DWI (Driving while intoxicated) first offense
Harassment
Prostitution (considered by some, but not all apts to be a sexual crime)
Terroristic threat (considered by many apts to be a violent charge)
Criminal trespass
Evading arrest on foot
False report to a police officer and false 911 calls
Child enticement
Failure to pay child support
Indecent exposure (considered by most, but not all apts, to be a sexual crime)
Minor drug possession
Vandalism

Class A Misdemeanors

Class A misdemeanors are the most serious type of Texas misdemeanors. Some apartments will ban the offender for an extended period of time for these offenses (in fact some ban for a lifetime for violent misdemeanor A). Examples include:


DWI (second offense)
Assault with bodily injury (considered by many apts to be a violent charge)
Burglary of a vehicle or vending machine
Possession of two to four ounces of marijuana
Unlawful carrying of a weapon
Gambling promotion
Violation of protective orders (considered by many apts to be a violent charge)
Cruelty to animals
Perjury
Public lewdness (considered by most, but not all apts, to be a sexual crime)
Resisting arrest
Unlawful restraint (considered by many apts to be a violent charge)
